About the Course
Judicial management ("JM"), which came into force in Malaysia on 1 Mar 2018, is a corporate rescue management mechanism that seeks the aid of the Court to save an ailing company from the threat of winding-up in the event that legal proceedings are commenced for any breach of contract. It is for this reason that JM is sometimes regarded as an alternative to winding-up, so as to provide solace to troubled companies hoping to seek a moratorium from legal actions, including the enforcement of legal proceedings. It is hoped that JM will afford ailing companies an opportunity to continue as a going concern and ensure their continued survival and existence. JM will be on the rise with the current and post COVID-19 pandemic.
This session will cover the salient principles of law to bear in mind, applicable provisions of the law, and the analysis of the salient case laws decided on JM. It will also cover the current trends on court decisions and developments in the law of JM.
Instructions
In order to complete this module successfully, ensure that you watch, for each video, at least 75% of the video duration in a single session and achieve a minimum score of 100% on the quiz. Upon successful completion of the course, you will receive 1 CPD point.

About the Presenter

Mr. Ranjan N Chandran
Ranjan N Chandran graduated with a Bachelor of Laws degree from the University of London in 1994 with a 2nd Class Upper Honours, and completed the Certificate of Legal Practice in 1995. He was admitted as an advocate and solicitor of the High Court of Malaya in 1996 and has been in practice for 25 years. He is currently a consultant with Hakem Arabi & Associates.
On judicial management, his article entitled "Judicial Management Solace or Discord Post Covid-19" was published in 2020 2 MLRA XVII. He was interviewed by The Edge Weekly in May 2020 on "Turning to Judicial Management to save ailing businesses".
He has spoken at several CPD seminars and webinars, including on the topic "The Corporate Rescue Mechanism of Judicial Management in Malaysia" on 27 Nov 2020. He is the author of the book entitled "Quick Guide Series Judicial Management Fundamental Principles & Analysis" published by Current Law Journal in 2021.
